§ 18-121. Uniform method of collection of security and landscape special assessments.

  • Upon compliance with the applicable procedures of F.S. § 197.3632 et seq. (the "Uniform Assessment Collection Act"), the Village Council may impose and collect security and landscape special assessments within the gated residential section of the Village, by way of the property tax bill method of collecting non-ad valorem assessments, which is authorized by that statute. Accordingly, the Village Council may, by Resolution, adjust and/or supersede the requirements and procedures of the remaining sections of this article V, for said security and landscape assessments, so as to conform to the Uniform Assessment Collection Act and to the applicable Resolutions which serve to implement article IX, "Assessments," of chapter 2 of the Village Code. In the alternative, the Village may elect to collect the security and landscape special assessments by any other method which is authorized by law, as provided in section 2-392 of article IX of chapter 2 of the Village Code. When invoked and implemented by the Village Council, the uniform method of collection, as described in section 2-391 of article IX of chapter 2 of the Village Code, shall supersede all other assessment requirements and procedures which are enumerated in the remaining sections of this article V.

Editor's note

Ord. No. 562, § 5, adopted June 19, 2012, provides that security and/or security and landscape assessments which are owed to the Village pursuant to the method of collection which was utilized by the Village prior to the imposition of the provisions of section 18-121 of the Village Code, as created pursuant to section 2 of this ordinance, shall remain due and owing until paid to Village, except to the extent, if any, that the outstanding obligation of a property is supplanted and transferred to the new assessment by the Village as authorized by law.
