§ 16-31. Hotels and condominium and apartment buildings.

  • (a)

    Indoor storage areas for buildings containing more than 100 hotel rooms or 100 residential units in the Village. All new construction or renovation/rehabilitation of hotels of more than 100 rooms or condominiums or apartment buildings of more than 100 units, valued at more than 30 percent of the building value of the existing building under construction are hereby required to provide suitable rooms within the walls of such buildings for the deposit and storage of Trash and Garbage. No such Trash or Garbage shall be stored on the outside of such buildings in bins or containers or otherwise. Any rooms which are provided inside such buildings for the storage of Trash and Garbage shall be:

    (1)

    Fireproof;

    (2)

    Air conditioned;

    (3)

    Equipped with adequate chutes within the buildings by which Trash and Garbage may be conveyed to the storage rooms; and

    (4)

    So constructed and maintained as to produce, as determined by the Village, no visual or odor impact on neighboring properties or public rights-of-way.

    Doors to such indoor Trash and Garbage storage areas shall stay closed at all times unless Trash or Garbage is being deposited or removed. Indoor Trash and Garbage storage areas and containers shall be frequently cleaned and disinfected, and no Trash, food waste or Garbage shall be permitted to fall on or remain on the ground or floor of that area.

    (b)

    All other storage areas. All hotels containing 100 or fewer rooms and condominiums or apartment buildings containing 100 or fewer units are required to fully enclose, screen and maintain all Trash and Garbage containers so as to produce, as determined by the Village, no visual or odor impact on neighboring properties or public rights-of-way. All enclosed or screened areas and the Trash and Garbage containers shall be frequently cleaned and disinfected, and no Trash, food waste or Garbage shall be permitted to fall on or remain on the ground or floor of that area. Any doors or gates to enclosed or screened Trash or Garbage storage areas shall be kept closed at all times unless Trash or Garbage is being deposited or removed.

    (c)

    Central Loading Area required. If storage rooms or areas for Trash and Garbage are not reasonably accessible for the employees of the Village or Franchisee and equipment engaged in the collection of Trash and Garbage, the owner, manager or operator of such hotel or condominium or apartment building shall make provision for a Central Loading Area and bring such Trash and Garbage to such area at such times as the Village or Franchisee is engaged in the pickup of Trash and Garbage so that no delay will ensue in the collection thereof.

    (d)

    Central Loading Area screening.

    (1)

    All new Central Loading Areas shall, to the maximum extent possible, not be located facing public right-of-way and shall be completely screened or enclosed so as not to be visible from the public right-of-way or adjacent properties. Screening may include building walls, a uniformly painted solid fence, wall, or permanent structural gates or doors, or any combination thereof.

    (2)

    All existing Central Loading Areas shall be fully screened to eliminate the visibility of all loading areas from the public right-of-way and adjacent properties as follows:

    a.

    Such screening may include permanent structural gates or doors; non-structural screens, fencing, walls, gates or doors; or landscaping a minimum of eight feet in height.

    b.

    The owner, manager or operator of each hotel or condominium or apartment building currently failing to provide the appropriate screening, shall, within 90 days of the effective date of this section, submit an application and appropriate plans to the Architectural Review Board providing for compliance with this section;

    c.

    Installation/construction and/or implementation of the approved plans, complying with this Section, must be complete no later than 90 days after the approval of such plans by the Architectural Review Board.

    (3)

    All doors, gates or screens to such Central Loading Areas shall be kept closed at all times except for active Trash and Garbage pickup or service deliveries.

    (e)

    Containers. Suitable and sufficient containers for Garbage and Trash shall be provided by the owner, manager or operator of each hotel or condominium or apartment building and shall be located at the discretion of the Village Manager. All Garbage and Trash shall be placed in watertight, galvanized or noncorrosive metal containers of a size, type and design approved by the Village. All such receptacles shall be equipped with a watertight cover sufficiently tight to prevent flies or other insects from having access to the contents of the receptacles. Such containers shall not exceed five cubic yards, and the total weight of any container, including Garbage and Trash contained therein and any attachments to the container, shall not exceed 6,000 pounds. All containers should be capable of being mechanically unloaded by the refuse collection vehicles of Village or Franchisee. All containers shall be equipped with caster wheels and shall be maintained by the owner in good repair and sanitary condition. Such containers shall not be filled beyond capacity, or in such a manner that the cover cannot be completely closed. Determination of compliance with these provisions shall be based upon the sole judgment of the Village. All Garbage and Trash containers shall be subject to inspection and approval, or condemnation through Code Enforcement. Failure to provide adequately maintained containers may result in suspension of service until proper containers are provided.

    (f)

    Refuse treatment. All Trash and Garbage shall first be drained of all liquids, placed and consolidated in plastic bags and deposited in the required containers. Trash and Garbage containers shall be kept tightly covered at all times, except when it is necessary to lift the cover to deposit or remove Trash and Garbage inside.

    (1)

    No hot ashes, tar, grease, chemicals, poisons, or other materials offering a hazard to collectors shall be placed in Trash and Garbage containers.

    (2)

    Temporary storage of Trash or Garbage or construction debris in an open container, or in a covered portion of garage, Central Loading Area, other loading area, or building is prohibited, except upon the written approval of the Village Manager if the area is completely screened from the view of the public right-of-way and adjacent properties.

    (g)

    Schedule and quantity of containers. If, as determined by the Village Manager, the containers used by any given establishment regularly are overfilled or produce foul odors, the Village Manager may require that the establishment utilize additional containers, larger containers and/or utilize more frequent Garbage and Trash pickup service.
