§ 10-31. Prohibited acts.

  • It shall be unlawful for any Person to:

    (1)

    Drive, operate, propel, or place any vehicle (whether or not such vehicle is motorized, propelled by human power or otherwise propelled) on the Public Beach or upon any public land, easement or right-of-way within the Public Beach. This prohibition does not apply to on-duty police or emergency vehicles or to the use of human powered, non-motorized bicycles pursuant to paragraph (1)a. below:

    a.

    The vehicle prohibition which is set forth in paragraph (1) above, is hereby modified so that human powered, non-motorized bicycles may be operated on a limited portion of the Public Beach, within the area which is described in Exhibit "A", a copy of which is attached hereto and incorporated herein, during daylight hours of each day between the time of sunrise and the time of sunset only, subject to posted rules and protocols governing the program for bicycle use as administered by the Village Manager or his designee.

    b.

    Further, notwithstanding the motorized vehicle prohibition which is set forth above, the Village Manager is hereby authorized to grant special permits for construction vehicles to temporarily utilize a limited portion of the Public Beach, within the area which is described in Exhibit "B", a copy of which is attached hereto and incorporated herein, upon the Village Manager finding that temporary construction vehicle access is necessary in order to provide ingress and egress to construction sites to complete pending ocean-front construction projects in a manner which minimizes interference with routine public road traffic within the Village or which facilitates convenient access of construction materials and supplies to portions of ocean-front construction sites.

    (2)

    Cut, break, tear, remove or damage plants, plant material, trees, shrubbery or any part thereof, including flowers or leaves, on the Public Beach.

    (3)

    Take any dog, cat or other animal, domestic or wild, into or upon the Public Beach, whether on leash, carried or running at large, except as provided for in subsection 5-5(c).

    (4)

    Build, ignite, maintain or cause to be built, ignited or maintained any fire in any area of the Public Beach except in such areas as are specifically designated therefor by the Village. No Person igniting or maintaining a fire shall leave the area without extinguishing the fire.

    (5)

    Erect, maintain or cause to be erected or maintained any tent, shelter or structure on the Public Beach.

    (6)

    Carry, possess or use air rifles, spring guns, slingshots, bows or arrows or any other form of weapon potentially inimical to wildlife or dangerous to human safety on the Public Beach. This section shall not apply to firearms as regulated by F.S. ch. 790.

    (7)

    Fish from areas which are posted to prohibit fishing.

    (8)

    Engage in the operation of any concession or commercial activity for the provision of motorized watercrafts, including Motorboats and Personal Watercrafts, or otherwise offer or enter into a license, lease or rental or other arrangement for the temporary use by another person or entity of a motorized watercraft, including Motorboats and Personal Watercrafts, on or at the Public Beach.
