§ 71. Zoning board of appeals.

  • There shall be a zoning board of appeals which shall consist of three (3) members to be appointed by the council for a term of three (3) years, except that of the members first appointed one shall be for a term of one year and one for a term of two (2) years. Any member of the board may be removed by the council. Any vacancy shall be filled by the council for the unexpired term of the member whose place has become vacant. All meetings of the board shall be held at the call of the chairman, who shall be designated by the council, and at such other times as such board may determine. All meetings of the board shall be open to the public. The board shall keep minutes of its proceedings, showing the vote of each member upon every question, or if absent or failing to vote, indicating such fact, and shall also keep records of its examinations and other official actions. Every order, requirement, decision or determination of the board shall immediately be filed in the office of the board and shall be a public record. The board shall have the power to hear and determine appeals from refusal of building permits and to permit exceptions to or variances from the zoning regulations in classes of cases or situations and in accordance with the principles, conditions and procedure specified in the zoning ordinance of the village and to make recommendations to the council for its action in such matters. The council's decision shall be final.
