§ 9-56. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Distributor means the Person or entity responsible for placing and maintaining a Newsrack in a public Street.

Village Manager refers to the Village Manager of Bal Harbour Village or the designee of the Village Manager.

Newsrack means any self-service or coin-operated box, container, storage unit or other dispenser installed, used or maintained for the sale of newspapers, magazines or other news periodicals or publications of general circulation.

Parkway means the grassy open area of public right-of-way located between the edge of the roadway and the nearest private property line adjacent thereto. Parkway shall also include any area within a roadway that is not open to vehicular traffic.

Person means any person or persons, or entity including, but not limited to, a corporation.

Roadway means that portion of a public Street improved, designed or ordinarily used for vehicular travel.

Sidewalk means any improved surface within the public right-of-way provided for the use of pedestrians.

Street means all that area dedicated to public use for public Street purposes and shall include, but not be limited to, Roadways, Parkways, alleys and Sidewalks.
