§ 6-181. Location and placement regulations.

  • (a)

    Small Satellite Dishes are permitted without prior approval or permitting requirements for all zoning districts and shall conform to the minimum setback requirements as are required for the principal building on the building site pursuant to the Village Code and any applicable Village Zoning Code in accordance with the following:

    (1)

    As an accessory use in R-1, R-2 and PC zoning districts, two Ground-Mounted Small Satellite Dishes are permitted per dwelling unit subject to the following conditions:

    a.

    No installation shall exceed fifteen (15) feet in height.

    b.

    Ground-Mounted Small Satellite Dishes shall conform to the minimum setback requirements as are required for the principal building on the building site pursuant to the Village Code and any applicable Village Zoning Code.

    c.

    Ground-Mounted Small Satellite Dishes shall conform to minimum setback requirements from any waterway as required for the principal building on the property pursuant to the Village Code and any applicable Village Zoning Code.

    (2)

    As an accessory use in R-1, R-2 and PC zoning districts, two (2) Roof-Mounted or Wall-Mounted Small Satellite Dishes are permitted per dwelling unit in lieu of Ground-Mounted Small Satellite Dishes, subject to all the following conditions:

    a.

    It is preferred that Roof-Mounted Small Satellite Dishes be mounted to the rear or side of the non-street side of the principal building.

    b.

    It is preferred that Wall-Mounted Small Satellite Dishes be mounted to the rear or side of the non-street side wall of the principal building.

    c.

    No installation shall exceed five (5) feet in height as measured from the roof or wall surface to the highest point of the dish in its most extended position.

    (3)

    No Ground-Mounted Small Satellite Dishes are permitted as an accessory use in RM1, RM2, RM3, RM4, RM5, B, OF and PD zoning districts.

    (4)

    As an accessory use in RM-1, RM-2, RM-3, RM-4, RM-5, B, OF and PD zoning districts, two (2) Roof- or Wall-Mounted Small Satellite Dishes are permitted per unit, subject to the following conditions:

    a.

    It is preferred that Roof-Mounted Small Satellite Dishes be mounted to the rear or side of the non-street side of the principal building.

    b.

    It is preferred that Wall-Mounted Small Satellite Dishes be mounted on the rear or side of the non-street side wall of the principal building.

    c.

    No installation shall exceed five (5) feet in height from roof or wall surface to the highest point of the dish in its most extended position.

    (5)

    The Village may inspect the installation to determine if it complies with the requirements of this Article and the Village Code.

    (b)

    Antennas are subject to the following installation requirements:

    (1)

    R-1 and R-2 zoning districts. In the R-1 and R-2 zoning districts, Ground-Mounted Antennas shall be permitted. Antennas on lots in the R-1 zoning district which abut the water, shall be located in the front (non-street side) or side of the lot. Antennas in the R-2 zoning district shall be located in the rear or side of the lot. Roof or Wall-Mounted Antennas shall be permitted, in lieu of Ground-Mounted installations, subject to the following conditions:

    a.

    Roof-Mounted and Wall-Mounted Antennas shall be mounted to the rear of the non-street side of the principal building.

    b

    Antennas on lots in the R-1 zoning district which abut the water, shall only be located in the front (non-street side) or side of the lot.

    c.

    No installation shall exceed five (5) feet in height from roof or wall surface to the highest point of the Antenna in its most extended position.

    (2)

    RM-1, RM-2 and RM-3 zoning districts. In the RM-1, RM-2 and RM-3 zoning districts, only Roof-Mounted Antennas shall be permitted. Antennas in these zoning districts shall be located at the rear of the principal building.

    (3)

    RM-4 and RM-5 zoning districts. In the RM-4 and RM-5 zoning districts only Roof-Mounted Antennas shall be permitted. Antennas in these zoning districts shall be located at the rear of the principal building. Antennas on lots in the RM-4 and RM-5 zoning district which abut the water shall be located on the principal building at a location closest to the water.

    (4)

    OF and PD zoning districts. In the OF and PD zoning districts Ground-Mounted or Roof-Mounted Antennas shall be permitted. Antennas in this zoning district shall be located in the side of the lot if Ground-Mounted or anywhere on the roof of the principal building if Roof-Mounted.

    (5)

    B zoning district. In the B zoning district, only Roof-Mounted Antennas shall be permitted. Antennas in this zoning district shall be located anywhere on the roof of the principal building.

    (6)

    PC zoning district. In the PC zoning district, only Roof-Mounted or Wall-Mounted Antennas shall be permitted. Antennas on lots in the PC zoning district shall be located on the side of the lot not closer than twenty-five (25) feet from an abutting lot.

    a.

    Roof-Mounted Antennas must be mounted to the rear of the non-street side of the principal building.

    b.

    Wall-Mounted Antennas must be mounted on the rear or non-street side wall of the principal building.
