§ 19-4. Parking in P Off-Street Parking District and on Herman B. Fultz Bridge.

  • (a)

    Parking control. A person parking within the P Off-Street Parking District as established by chapter 21, and within the right-of-way of the Herman B. Fultz (Baker's Haulover) Bridge (collectively, the "District") shall comply with this section and with the posted times on signs marking individual spaces or areas. Government-owned vehicles and vehicles owned by government officials or government employees conducting official government business are exempt from this section.

    (b)

    Parking of automobiles only. No land in the District shall be used for other than the accommodation of public facilities, including the parking of automobiles. Within the right-of-way of the Herman B. Fultz Bridge, the parking of automobiles shall only be in spaces, the use of which may be controlled by parking meters installed by the Village for that purpose.

    (c)

    Overnight parking prohibited. No person shall cause any motor vehicle operated by that person to be parked within the District between the hours of 10:00 p.m. and 6:00 a.m. the following day.

    (d)

    Head-in parking only. All areas within the District shall be designated for head-in parking only.

    (e)

    Overtime parking. Any person may cause a vehicle to park within the District so long as such person upon entering a parking space immediately pays for parking. Vehicles parked within the District beyond the time paid for shall be considered to be parked overtime in violation of this section. A subsequent violation occurs if the vehicle remains after issuance of a citation for an additional time period which exceeds the time designated for the space. The maximum designated time for parking shall be three hours, however, any person may exceed this time period by paying for additional time subject to other restrictions in this section including but not limited to subsection (c) above.

    (f)

    Separate violations. Each day or distinct time period of an offense described by this section shall be considered a separate violation subject to a separate penalty as described by this section.

    (g)

    Towing of vehicles authorized. The Police Department may immediately cause to be towed any illegally parked motor vehicle in accordance with this section. All expenses for towing and impoundment shall be the responsibility of the owner of the vehicle. All towing and impoundment hereunder shall be accomplished in accordance with this section and applicable state, county and federal law.

    (h)

    Parking meter fees. The Village Council shall by resolution establish a rate schedule for parking meters located within the District. The rate schedule shall be clearly posted on the parking meters or on the parking fee payment equipment, and may be revised by a resolution of the Village Council.
