§ 16-51. Franchise required.

  • (a)

    It shall be unlawful for any person to remove, collect and transport for disposal, from any Commercial Establishment, any Solid Waste or recyclable material over the streets or public rights-of-way within the incorporated area of the Village without first applying for and receiving the appropriate Solid Waste franchise from the Village to carry on such business. A complete list of the Commercial Establishments to which a franchisee may lawfully provide Solid Waste collection, transport, and disposal services shall be available from the Village Clerk.

    (b)

    The Village shall not issue a franchise for, nor shall any person or entity receiving a franchise under this article engage in, the removal, collection or transport for disposal, any Solid Waste from any Residential Unit or Multifamily Residential Establishment within the Village without the prior written consent of the Village Manager.

    (c)

    The franchise required by this section shall be in addition to any other permits, registration or local business tax receipt which may be required by federal, state or local law.
