§ 16-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Central Loading Area means an area of a property or establishment, meeting the requirements of this Chapter, where Trash and Garbage can be temporarily gathered for reasonable access by the employees of the Village or a Franchisee and their respective equipment engaged in the collection of Trash and Garbage.

    Commercial Establishment means any structure used or constructed for use for business operations. For purposes of this article, hotels, hotel-condominiums and motels are commercial establishments. The term "commercial establishment" shall not include any residential unit or multifamily residential establishment.

    Customer means a person who uses the Solid Waste or recycling services of a Private Hauler.

    Franchisee means the named person who obtains a franchise from the Village pursuant to article III.

    Garbage means every refuse accumulation of animal, fruit or vegetable matter that attends the preparation, use, cooking, dealing in or storage of meats, fish, fowl, fruit or vegetables, and any other matter of any nature whatsoever which is subject to decay and the generation of noxious or offensive gases or odors, or which, during or after decay, may serve as breeding or feeding material for flies or other germ-carrying insects; and any bottles, cans or other containers which, due to their ability to retain water, may serve as breeding places for mosquitoes or other water-breeding insects. Dead animals are not considered garbage, and their disposal is the responsibility of Miami-Dade County.

    Multifamily Residential Establishment means any structure other than a residential unit which is used, or constructed for use, as a multiple dwelling facility. Multifamily residential establishments shall include, without limitation, roominghouses, tourist courts, trailer parks, apartment buildings with rental or cooperative apartments, or multiple-story condominiums with common means of ingress and egress. The term "Multifamily Residential Establishments" shall not include buildings operated as hotel-condominiums. Hotel-condominiums constitute Commercial Establishments hereunder.

    Person means any natural person, individual, public or private corporation, firm, partnership, association, joint venture or municipality, or any combination of such, jointly or severally.

    Private Solid Waste Hauler (collector), Private Hauler and Hauler mean any person who removes, collects and transports for disposal for hire any Solid Waste over the streets or public rights-of-way within the incorporated area of the Village.

    Recovered Materials shall mean metal, paper, glass, plastic, textile, or rubber materials that have known recycling potential, can be feasibly recycled, and have been diverted and source separated or have been removed from the Solid Waste stream for sale, use, or reuse as raw materials, whether or not the materials require subsequent processing or separation from each other, but does not include materials destined for any use that constitutes disposal. Recovered materials as described above are not Solid Waste.

    Residential Unit means any structure which is used, or constructed for use, as a single-family dwelling, duplex, cluster house or townhouse, and which is located on a single lot, parcel or tract of land. For the purposes of this article, any condominium structure composed of privately owned single-family housing units with separate means of ingress or egress and containing no more than two stories shall be considered a residential unit. The term "residential unit" shall not include any multifamily residential establishment.

    Solid Waste means garbage, trash, litter, yard trash, hazardous waste, construction and demolition debris, industrial waste or other discarded material, including solid or contained gaseous material resulting from domestic, industrial, commercial, mining, agricultural or governmental operations.

    Solid Waste Disposal means disposition of Solid Waste by means of combustion, land filling or other final method of discard.

    Trash means every waste accumulation of paper, sweepings, dust, rags, bottles, cans or other matter of any kind, other than Garbage, which is usually attendant to the business or general housekeeping use.
