§ 13-30. Disability.

  • (a)

    Basis for Consideration. If a Participant incurs, at any time prior to his normal retirement date, a disability which the Retirement Board determines, after considering the opinion of a physician selected by the Retirement Board, renders the Participant unable to perform either his current or regular duties or the functions or duties of any other Village job or employment position made available to such disabled Participant by the Village, such Participant shall be considered totally disabled for purposes of this Plan and trust. Such a condition shall be considered to be a total disability for purposes of this Plan when it has existed on an uninterrupted basis for a continuous period of at least six months.

    (b)

    Payment. If a Participant shall become disabled as defined herein, he shall become fully vested to his accrued benefits as of date of disability; and the Retirement Board shall take such action as may be necessary to provide benefits in an amount to be determined and calculated as though such Participant were eligible for and had retired on an early retirement benefit as provided in section 13-28(d).

    (c)

    Rules and Procedures . The Board may adopt such rules and procedures as are necessary to carry out the intent of this section.
